·Reviewssalesbidsandcoordinatewithotherdepartmentstoensuresalesopportunitiesaremadeconsistentlywithintheframeworkofthegroup’spolicies;theCManalysesallcontractualmaterial(SOW,T&Cs…)andliaiseswithrelevantdepartmentsinordertoidentifyrisksandfindmitigationoptionsandprovidesweightedriskstobeincludedinpricingsheet.
·SupportsPurchasingDepartment:theCMensuresthatrelevantflowdownofobligationstosub-contractorsisinplaceandsecuresconsistencybetweensub-contractors/supplierscommitmentsandtheonesThalescommittedtocustomers.
·InliaisonwithExportControlOfficer,theCMensuresthatexportconstraints,ifany,aswellasallotherregulationrequirementsareidentifiedandproperlyaddressed.
·Inliaisonwithfinanceandotherrelevantexperts,theCMensuresthatallfinancialaspectsofthebid(payments,securityofpayments,bankguarantees,etc)aswellasallinsuranceissuesareproperlyidentifiedandaddressed.
·Inliaisonwithrelevantfunctions,theCMmanagesallcontractualaspectsoftheinternalbidprocessandtendervetfiling/documentation.
·LeadsorsupportswhererelevantinnegotiatinganddraftingofT&Cswithcustomersandsub-contractors.
·Ensureseachcontractualfileissufficientlydocumentedandretainedperthegroup’sprocesses.
2.DuringPost-award(orProjectdelivery)–theCMismainlyinsupportoftheProjectManager:
.TheCMassiststheProjectManager(PM)intheadministrationofallaspectsofthecontract,includingthesetting-upofthecontractualbaseline.
.TheCMassiststhePMandtheProjectFinancialController(ifany)inthepreparationoftheProjectRiskAssessmentandMitigationPlan.
.TheCMidentifies(withthePM)potentialopportunitiesofamendmentstothecontractandpreparesthematerialforChangeProposalsnegotiations.
.TheCMisresponsibleforensuringthatthecontractualbaselinewithcustomerandsub-contractorsisproperlyandtimelyupdatedandtraceable.
.TheCM,incooperationwithProjectteam,tracksinwritingwithduedetailanyactualdeviationfromcontractualprovisions,suchas,butnotlimitedto:
§QuantitydifferencesprovidedbySuppliers,co-contractorsorCustomers
§Qualitydiscrepancies
§DeviationsinDesignandEngineeringdocuments
§Duedates
andkeepsupdatedrecordsoftheeconomicimpactofsuchdeviationsontheProjectbalancesheet.TheCMensuresthatsupportingwrittenevidenceregardingallsuchdeviationsexistandareavailable.
.TheCMidentifies(withthePM)potentialrisksofdelays(andothercommercialrisks)andcontinuouslyattemptstoreducesuchrisks.TheCMpreparestheliquidateddamagesfilesandparticipatesintheirnegotiation.
.WiththesupportofExportControlOfficer,theCMmakescertainthattheexportregulationsandotherregulationrequirementsarestrictlyfollowed.
.TheCMisresponsible(withthePM)fordraftingletterstoCustomers,Partners,Subcontractors,inliaisonwithLegalasrequired,andleadsclaimsandpre-litigationcasesinclosecoordinationwithLegal.
.TheCMassists,withPMsupport,inpreparationofclaimfilesforlitigiouscasesledbyLegal.
.TheCMassiststhePMandtheProjectFinancialController(ifany)inthefinalsettlementofanywarranties,bankguarantees,post-commissioningcommitmentsandanythingwhichmightbenecessarytoensurethepropercompletionoftheContract.
